Ferguson Hyams is regulated in Australia. It is not licensed, authorised or registered with any financial services regulator outside Australia, and nothing on this website should be taken to suggest otherwise.

It is made available only after you have declared your location and investor category, and — where the laws of your jurisdiction require it — only after Ferguson Hyams has confirmed that you qualify to receive it. No Offer Document is addressed to any person in any jurisdiction where its distribution would be unlawful.
3. Eligible investors — how fund information is provided
If you contact Ferguson Hyams to enquire about a Fund, Ferguson Hyams will first confirm whether you qualify under the laws of your own jurisdiction to receive information of that kind. Fund information is provided only to persons who so qualify, including:
Australia
“Wholesale clients” within the meaning of section 761G of the Corporations Act 2001 (Cth), and persons to whom offers may lawfully be made without a product disclosure statement.
New Zealand
“Wholesale investors” within the meaning of clause 3 of Schedule 1 of the Financial Markets Conduct Act 2013 (NZ). No product disclosure statement under that Act has been or will be prepared for any Fund.
United Kingdom
Persons falling within the exemptions in the Financial Services and Markets Act 2000 (Financial Promotion) Order 2005, including investment professionals (article 19), high net worth companies and unincorporated associations (article 49), and certified high net worth or certified/self-certified sophisticated investors (articles 48 and 50/50A). Ferguson Hyams verifies the status of UK enquirers, using the prescribed statements where applicable, before any promotional material or fund figures are provided.
European Economic Area
“Professional clients” within the meaning of Directive 2014/65/EU (MiFID II), and only in member states where the relevant Fund may lawfully be marketed under the applicable national private placement regime or where the communication is otherwise lawful. No Fund is notified for marketing under Directive 2011/61/EU (AIFMD) in any member state; until such notification, no fund information is made available on this website to visitors in the EEA.
Hong Kong
“Professional investors” within the meaning of the Securities and Futures Ordinance (Cap. 571) and its subsidiary rules. The contents of this website have not been reviewed or authorised by the Securities and Futures Commission. No Fund is authorised under section 104 of the SFO, and no advertisement, invitation or document relating to any Fund may be issued to the public of Hong Kong other than to professional investors, in accordance with section 103 of the SFO.
Singapore
“Institutional investors” or “accredited investors” within the meaning of the Securities and Futures Act 2001. Any offer of interests in a Fund in Singapore is made only as a restricted scheme under section 305 of that Act. The Offer Document is not a prospectus and has not been, and will not be, registered with the Monetary Authority of Singapore, and statutory liability for prospectus content does not apply. Interests acquired under section 305 are subject to the resale and transfer restrictions in the Act.
Other jurisdictions
Persons who are institutional, professional, qualified or equivalent investors under the laws of their own jurisdiction, where receipt of the information is lawful without any registration, licensing or approval by Ferguson Hyams.
When you access the fund pages of this website or submit an enquiry, you will be asked to state your country of residence and to declare the investor category under which you qualify. Ferguson Hyams may require evidence of your status (including, where applicable, an accountant’s certificate or a signed investor statement) before providing any Fund information, and reserves the right to decline any enquiry.
If you do not fall within a category above, this website’s content is provided to you as general information about Ferguson Hyams only, and no Fund information will be made available to you. You are welcome to read about our firm, our team, our community work and our educational guides.
4. United States
The Funds have not been and will not be registered under the United States Securities Act of 1933 or the Investment Company Act of 1940, and interests in the Funds are not being offered in the United States or to U.S. Persons (as defined in Regulation S). Nothing on this website is directed at any person in the United States.
5. Performance, forward-looking statements and risk
Any performance information provided to eligible investors is historical. Past performance is not a reliable indicator of future performance. 6. Intermediaries, platforms and product providers
Where information on this website is accessed by or provided to a licensed intermediary, adviser platform, life assurance company, trustee or other product provider, it is provided to that firm in its professional or institutional capacity only, for the purposes of its own assessment and due diligence of the relevant Fund. It is not intended for onward transmission to retail clients, policyholders or scheme members, and must not be reproduced in or used as the basis for any communication addressed to them.
